29 CFR  1926.651(e): Employee was not prohibited to be underneath loads handled by lifting or digging equipment:  (a) On or about April 25, 2023, an employee was working in an excavation while directly below the excavator bucket and chain slings that were attached to a John Deere 135G Excavator arm. The excavator was being used to lift and place a six (6) foot long by eight (8) foot tall trench box in the excavation. The location of the bucket and chain slings above the employee exposed the employee to a struck-by and crushing hazard.

29 CFR  1926.652(c)(2)(ii): Deviation from the specifications, recommendations, and limitations issued or made by the manufacturer was made without  specific written approval from the manufacturer.  (a) On or about April 25, 2023, employee(s) were using a trench shield identified as Pro-Tec Model PAL3-86SNOKE that had been modified with  (6) drilled holes in the vertical support beams  and eight (8) welds placed on the vertical support beams, without specific written approval being requested  from, and provided by the manufacturer prior to use of the shielding  device in the approximately nine (9) foot, four (4) inches deep excavation.
