29 CFR  1910.268(n)(12): Working position on poles. Climbing and working are prohibited above the level of the lowest electric power conductor on the pole (exclusive of vertical runs and street light wiring):   An employee was engaged in telecommunications activities at an existing residential building located at 1002 Avenue B, Bayard, NE 69334, and was exposed to electrocution hazards while working above the lowest horizontal live conductor during a telecommunications line installation exposing the employee to approximately 2.4Kv.

29 CFR  1910.268(n)(12)(ii):Where the electric power conductors are cabled secondary service drops carrying less than 300 volts to ground and are attached 40 inches or more below the communications conductors or cables.  An employee was engaged in telecommunications activities at an existing residential building located at 1002 Avenue B, Bayard, NE  69334, and was exposed to electrocution hazards in that they were in the immediate proximity of secondary service drops that were less than 300 volts.

The employer did not provide an authorized government representative the records within the four business hours.  Charter Communications failed to provide their OSHA 300 Logs for the facility located at 1204 Avenue, Scottsbluff, NE 69361 to an authorized OSHA representative until after 44-days had passed since this original written and oral request was made.
