29 CFR 1926.100(b): Helmets for the protection of employees against impact and penetration of falling and flying objects did not meet the specifications contained in American National Standards Institute Z89.1-1969, Safety Requirements for Industrial Head:   (a) On or about May 3, 2023, hardhats were not worn by two employees as they were exposed to overhead hazards of being struck by materials while working in an excavation.

29 CFR 1926.651(c)(1)(i): Structural ramps used for access or egress of equipment were not constructed in accordance with the design: (a) Excavation site at Hagman Street, Eau Claire, WI; On or about May 3, 2023, a means of egress was not readily accessible from an excavation that was approximately 121 feet long and ranged in depth from 6-feet, 7-inches to 7 feet at the observed work area.  The ladder near the work area was lying outside of the excavation and the nearest exit was approximately 100 feet away.  American Express Transportation, LLC was previously cited for a repeat violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 1399170, citation number 2, item number 1 and was affirmed as a final order on June 27, 2019, with respect to a workplace located at a site near 4755 London Road, Eau Claire, WI.  American Express Transportation, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 1346143, citation number 1, item number 1a and was affirmed as a final order on December 11, 2018, with respect to a workplace located at a site near 1430 Rivers Edge Trail, Altoona, WI.
