29 CFR  1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  Location: 60 Green Pond Road. Rockaway, New Jersey 07866  a) The employer did not administer a continuing, effective hearing conservation program for employees that had a noise exposure exceeding 85 decibels measured on the A scale, as an 8-hour time-weighted average.  Employees working in the warehouse were exposed to noise levels that were equivalent to 135.8%, 120.8% and 84.2% of the allowable dose of 100%, or 90dBA for an 8 hour Time Weighted Average. These exposures, which are equivalent to an 8 hour Time Weighted Average of 92.2dBA, 91.4dBA and 88.8dBA respectively, exceeded the Action Level of 50%, or 85dBA. The sample times were 399 minutes, 337 minutes and 350 minutes respectively.  Zero exposure was assumed for the unsampled time periods of 81 minutes, 143 minutes and 130 minutes respectively.  Violation occurred on or around May 4, 2023.

Rockaway, New Jersey  a) The employer did not make audiometric testing available for employees whose exposure levels for noise may equal or exceed the action level of 85 decibels measured on the A scale as an 8-hour time-weighted average. Rockaway, New Jersey 07866  a) The employer did not ensure that employees working in areas where their exposure to noise equaled or exceeded an 8-hour time-weighted average of 85 decibels were wearing hearing protection.
