OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards A.) Jobsite located at: 114 Adler Street, West Babylon, NY, 11704 - Mulch Area (rear yard): On or about May 8, 2023, a CATERPILLAR Payloader 966F was operated with the load in front in the raised position obstructing a clear line of vision as the operator traversed yard. The payloader struck an employee that was cleaning up debris in the mulch storage area. Note: In addition to abatement certification, the employer is required to provide abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1910.132(a):Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: Jobsite located at: 114 Adler Street, West Babylon, NY, 11704 - Mulch Area (rear yard): On or about May 8, 2023, an employee who was cleaning up debris in the mulch storage area, where there was heavy equipment and vehicular traffic, was not wearing a high visibility safety vest, and was struck by a payloader. Note: In addition to abatement certification, the employer is required to provide abatement documentation for this item in accordance with 29 CFR 1903.19
