29 CFR  1910.1053(g)(2): Where respirator use was required by this section, the employer did not institute a respiratory protection program in accordance with 29 CFR 1910.134: a) Mixing Plant/Sand Plant; on or about September 7, 2023, and times prior, the employer exposed employees to respiratory hazards associated with silica dust. Employees were exposed to silica at an 8-hour AL of 47.9�g/m3 ; approximately 1.92 times the action limit of 25�g/m3.  The exposure level was derived from one sample collected over a 479 minute sampling period.  Zero was assumed for the unsampled period of one minute. Respirators with tight-fitting  facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function, and the employer did not ensure that these employees facial hair did not  protrude under the respirator seal.
