OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling trailers. a) On or about May 9, 2023, and at times prior thereto, in a materials storage yard, where an employee unloading construction aggregate from an end dump trailer was exposed to struck-by hazards from falling trailers that were not aligned with the truck, parked on unlevel and shifting ground conditions, and the load was not inspected for even distribution.
