OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees engaged in service and maintenance activities:  On or about May 14, 2023, at Prairie State Generating Company, following the host employer?s lockout and tagout of Submerged Flight Conveyor #1, the employer failed to develop, document, or utilize procedures for the control of stored, residual or reaccumulated hazardous energy in the conveyor chain and flights of Submerged Flight Conveyor #1. Employees were exposed to struck-by hazards when they manually rotated the conveyor drive system.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and  was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):   On or about May 14, 2023, at Prairie State Generating Company, Submerged Flight Conveyor #1, two employees were exposed to hazardous energy generated by the weight of the conveyor flights and chain applying pressure to a drive system. The employer failed to implement energy control application steps and the employees conducting the work did not have knowledge of type and magnitude of the gravity energy present [(d)(1)], did not isolate the dry side of the chain to prevent gravity energy to be applied to drive system [(d)(3)], did not relieve, disconnect, restrain, or render it safe [(d)(5)], and did not verify that the drive system was isolated.
