29 CFR 1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces were kept in a clean, orderly, and sanitary condition: (a)American Engineered Products, LLC at 605 4th Street Southeast, De Smet, SD 57231: On or about and at times prior to May 16, 2023, the employer did not ensure that employees were protected from potential fire, deflagration and explosion hazards involving accumulated powder coating which is a Class II combustible dust in excess of 1/32 inch on surface areas such as the foundation, walls, and other equipment within the areas surrounding the spray booth, were effectively kept clean. This condition exposed employees to the hazard of fire and explosion involving Class II combustible powder coating dust. Abatement Note: Immediate cleaning is warranted whenever a dust layer of 1/32-inch thickness (thickness of a typical paper clip) accumulates over 5% of the surface area in the work area. Surfaces that can accumulate dust include foundation, walls, and tops of equipment. Also, compressed air should not be used to clean areas as it only functions to scatter dust further.

The equivalent dBA level of 130% is approximately 91.94 dBA. The sampling was performed on May 16, 2023 for 511 minutes. The adjusted and corrected dBA for extended workshifts is 84.5 dBA. (c)American Engineered Products, LLC at 605 4th Street Southeast, De Smet, SD 57231: On or about and at times prior to May 16, 2023, an employee performing grinding on welded metal was exposed to continuous noise levels at 81.46% dose of the allowable 8-hour time-weighted average action level for noise (85 dBA). Electrical wiring, motors, and other equipment outside of but within twenty (20) feet of any spraying area, and not separated therefrom by partitions, shall not produce sparks under normal operating conditions and shall otherwise conform to the provisions of subpart S of this part for Class I, Division 2 Hazardous Locations: (a)American Engineered Products, LLC at 605 4th Street Southeast, De Smet, SD 57231: On or about and at times prior to May 16, 2023, the employer did not ensure that employees were protected from fire, or explosive hazards in that exposed wires in an open box on the wall behind the powder coat booth were not covered within an intrinsically safe or explosion proof box. This condition exposed employees to fire and explosion hazards.
