29 CFR 1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces were kept in a clean, orderly, and sanitary condition:  (a)American Engineered Products, LLC at 605 4th Street Southeast, De Smet, SD 57231: On or about and at times prior to May 16, 2023, the employer did not ensure that employees were protected from potential fire, deflagration and explosion hazards involving accumulated powder coating which is a Class II combustible dust in excess of 1/32 inch on surface areas such as the foundation, walls, and other equipment within the areas surrounding the spray booth, were effectively kept clean.  This condition exposed employees to the hazard of fire and explosion involving Class II combustible powder coating dust.  Abatement Note: Immediate cleaning is warranted whenever a dust layer of 1/32-inch thickness (thickness of a typical paper clip) accumulates over 5% of the surface area in the work area. Surfaces that can accumulate dust include foundation, walls, and tops of equipment.  Also, compressed air should not be used to clean areas as it only functions to scatter dust further.

29 CFR 1910.95(c)(1):  A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employee noise exposures equaled or exceeded an 8-hour time-weighted average (TWA) sound level of 85 dBA or a dose of 50%:    (a)American Engineered Products, LLC at 605 4th Street Southeast, De Smet,  SD  57231 has not developed and implemented a hearing conservation program including a monitoring program to quantify employee exposures to noise, employee notification of monitoring results, audiometric testing including baseline and annual audiograms, use of hearing protectors, training on the hazards associated with noise, and recordkeeping.  This exposes employees to hearing loss hazards.    (b) American Engineered Products, LLC at 605 4th Street Southeast, De Smet,  SD  57231:  On or about and at times prior to May 16, 2023, an employee performing grinding on welded metal was exposed to continuous noise levels at  130% dose of the allowable 8-hour time-weighted average action level for noise (85 dBA).  The equivalent dBA level of 130% is approximately 91.94 dBA.  The sampling was performed on May 16, 2023 for 511 minutes.  The adjusted and corrected dBA for extended workshifts is 84.5 dBA.  (c)American Engineered Products, LLC at 605 4th Street Southeast, De Smet,  SD  57231:  On or about and at times prior to May 16, 2023, an employee performing grinding on welded metal was exposed to continuous noise levels at  81.46% dose of the allowable 8-hour time-weighted average action level for noise (85 dBA).  The equivalent dBA level of 81.46% is approximately 88.52 dBA.  The sampling was performed on May 16, 2023 for 521 minutes.  The adjusted and corrected dBA for extended workshifts is 84.4 dBA.  (d)American Engineered Products, LLC at 605 4th Street Southeast, De Smet,  SD  57231:  On or about and at times prior to May 16, 2023, an employee performing welding of metal parts was exposed to continuous noise levels at  79.99% dose of the allowable 8-hour time-weighted average action level for noise (85 dBA).  The equivalent dBA level of 79.99% is approximately 88.39 dBA.  The sampling was performed on May 16, 2023 for 523 minutes.  The adjusted and corrected dBA for extended workshifts is 84.4 dBA.
