OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire, flash fire, deflagration, or explosion associated with combustible dust.   (a) Production Hallway Area- Employees were exposed to fire, deflagration and explosion hazards due to the Hi- VAC HV-875SP Model 875 Industrial Vacuum located inside the building was not designed and installed to protect employees from fire, deflagration and explosion hazards, collecting combustible dust from seventeen encapsulation/tablet production machines located in the individual Hallway rooms, on or about 5/13/23.  (b) Production Hallway Area-Employees were exposed to fire, deflagration and explosion hazards due to the Donaldson Model SME-72 Dust Collector was not designed and installed to protect employees from fire, deflagration, and explosion hazard, collecting combustible dust from seventeen encapsulation/tablet production rooms, on or about 5/13/23.  (c) Shipping area- Employees were exposed to fire, deflagration and explosion hazards from the exhaust vent from the Hi-VAC HV-875SP Model 875 Industrial Vacuum vent piping, which was not designed or installed properly such that it would protect employees from fire, deflagration, and explosion hazards. The vent was curved and extended 90 feet from the collector to the exit of the building, on or about 5/13/23.  (d) Production Hallway Area- The 4 inch PVC and metal piping ducts collecting combustible dust from the seventeen encapsulation/tablet production rooms and venting to the Donaldson dust collection system, Model SME-72, systems were not designed to prevent build up of static electricity, on or about 5/13/23.  (e) Production Hallway Area-Employees were exposed to fire, deflagration and explosion hazards when manually scooping, pouring and transferring combustible dust from PVC processing buckets into encapsulation/tablet machine hoppers with stainless steel scoops, on or about 5/13/23    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
