OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that an employee was employees exposed to struck-by and caught in-between hazards:    a) 621 Hook road, Folcroft, PA 19032, first bay of transmission shop - On or about May 19, 2023, an employee was exposed to caught-between and/or struck-by hazards when he was working in the path of a 1989 Grumman Olson Van being loaded onto a Mohawk TR25a vehicle.

29 CFR  1910.1200(e)(1):Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):   a) Jobsite located at 621 Hook Road, Folcroft, PA - A written Hazard Communication Program was not developed or implemented where employees were exposed to hazardous chemicals such as, but not limited to contained in products used at the worksite, including but not limited to  -propane, ethane, butane contained gas contained in approx.. 20 lbs cylinder  -isobutane, propane, 2-butoxyethanol, etc. contained in P.W.D 660. -etc.  Condition observed on or about May 20, 2023.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a) Jobsite at 621 Hook Road, Folcroft, PA - The employer did not provide hazardous chemical training for employees engaged in auto transmission repair services. Employees were not trained on the hazardous chemicals, including but not limited to:  -propane, ethane, butane contained gas contained in approx.. 20 lbs cylinder  -isobutane, propane, 2-butoxyethanol, etc. contained in P.W.D 660. -etc.  Condition observed on or about May 20, 2023.
