29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids, or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a) On May 23, 2023, at a residential construction site located at 1442 11th Avenue South, in Fargo, ND,  employees were working in close proximity to other employees operating pneumatic nail guns at approximately 120 psi and were exposed to eye and face hazards from flying particles.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net systems, or personal fall arrest system:  (a) On or about May 23, 2023, at a residential construction site located at 1442 11th Avenue South, in Fargo, ND, employees were engaged in roofing activities on a residential construction site, the employees were exposed to fall hazards greater than 6 feet without a fall protection system in place.
