29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: At the construction site located at 808 Laclede St, Lebanon, Missouri employees were exposed to fall hazards. a) At the construction site located at 808 Laclede St, Lebanon, Missouri employees were exposed to a fall hazard. A drywall finisher unloading materials from deck on the southeast corner of the building was working at height. The deck had no guardrails in place to keep the employee from falling to the ground, which was 21 feet below. No alternative means of fall protection was in use. b) At the construction site located at 808 Laclede St, Lebanon, Missouri employees were exposed to a fall hazard. A drywall finisher unloading materials from job made trash box was working at height. The employee was not wearing a personal fall arrest system while standing in the box, which was approximately 21 feet above the ground. No alternative means of fall protection was in use. This resulted in fatal injuries when the box tipped off the forks.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: At the jobsite located at 808 Laclede St in Lebanon, Missouri employees were exposed to fall hazards. The employer had not developed or implemented a training program addressing fall hazards for employees working from heights. Employees, including one who fell approximately 21 feet to the ground and was fatally injured, had not been trained on the hazards associated with working at heights or the selection and use of fall protection.

29 CFR 1926.602(d): The employer did not ensure that each employee operating a powered industrial vehicle had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178. and as referenced by the note contained in 1926.602(d): Employees were exposed to struck by hazards while operating and working around a telehandler when they were not trained on the use of, or hazards associated with using powered industrial trucks. An employee used the Dynalift Telehandler to lift a box to deliver materials to an elevated balcony.
