29 CFR  1910.266(h)(1)(vi): Each danger tree, including lodged trees and snags, was not felled or removed using mechanical or other techniques to minimize employee exposure before work is commenced in the area of the danger tree.    a) Cut site; On or about June 1, 2023, the owner did not remove a broken tree that was knocked over the cut road when he previously cut down a tree next to it. The broken section was not fully detached from the trunk when it fell over, and the weight of the majority of the tree was putting pressure on the broken area exposing the employees to struck by hazards.

29 CFR  1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident   a) Pickens, WV; On or about June 1, 2023, at 1:20pm, an employee was struck by a Maple tree, which resulted in the employee's death.  The fatality was reported on June 2, 2023 at 8am by the county medical examiner.

29 CFR  1910.266(i)(7)(i): The employer did not assure that each employee, including supervisors, had received first-aid and CPR training meeting at least the requirements specified in Appendix B:  a) Pickens, WV: On or about June 1, 2023, and times prior, employees were removing trees on logging sites.  Not all employees working onsite were trained in first aid.
