29 CFR  1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following:  Guardrail systems, safety net systems, or personal fall arrest systems:  a.) South Building Picking Warehouse - On or about April 14, 2023, near an elevated conveyor, an employee was observing work being done by two (2) third-party contractor employees while standing on the top shelf of an adjacent racking system without be provided the appropriate fall protection, which exposed the employee to a five (5) foot four (4) inch fall.  The employee fell when attempting to climb down the racking system and sustained a head injury when contacting the concrete floor below.

29 CFR  1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours.   a. On or about April 14, 2023, the employer did not contact OSHA within 24 hours when an employee sustained a work-related injury that resulted in an in-patient hospitalization.
