29 CFR  1904.40(a):The employer did not provide an authorized government representative the records within the four business hours.  On or about August 10, 2023, OSHA formally requested by subpoena, copies of the injury and illness records for the years 2020 through 2023. OSHA followed up on this request in writing on 8/30/2023 and specifically informed the employer of the requirement to provide the requested documents within four hours. The employer, however, did not provide those records to OSHA until on or about September 7, 2023.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and caught between hazards while working in the vicinity of a Bobcat Compact Track Loader.  Location: Brockton Hospital 680 Centre St. Brockton, MA 02302  On June 13, 2023, an employee was exposed to struck by and caught between hazards when a Bobcat Compact Track Loader tipped over on him while he was in close proximity to the Bobcat's bucket.
