1910.178(q)(1) Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel. On or about June 16, 2023, at 7835 Northwest 53rd Street, Suite A, Doral, Florida, an untrained employee was exposed to fall, struck-by, and caught-between hazards while operating a forklift without using the powered industrial truck's (PIT) seatbelt.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about June 16, 2023, at 7835 Northwest 53rd Street, Suite A, Doral, Florida, employees were exposed to struck-by and caught-between hazards when a Clark C500 forklift was being operated before the employer ensuring the powered industrial truck (PIT) operator was competent to operate the equipment.
