29 CFR  1926.602(c)(1)(vii): Unauthorized personnel were permitted to ride on powered industrial trucks or a safe place to ride was not provided where riding of trucks was authorized:  On or about June 20, 2023, on a sloped gravel road near the installation area at the worksite in Columbia, LA; an employee was exposed to fall/crushing hazards when riding on a load of wooden fence posts that was being transported on the forks of a Mahindra Shuttle tractor (Model 2645L).

29 CFR  1926.602(d): The employer did not ensure that each employee operating a powered industrial vehicle had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178 and as referenced by the note contained in 1926.602(d):  On or about June 20, 2023, operators of a Mahindra USA, Inc shuttle tractor 2645L and a Komatsu, LTD backhoe PC240LC-11a were not trained and evaluated in the safe operation of powered industrial trucks, exposing employees to struck-by /crushing hazards when transporting loads/materials.
