29 CFR 1960.8(a): The Agency head did not furnish employment and a place of employment to each employee that were free from recognized hazards that caused or were likely to cause death or serious physical harm to include communication when responding to emergency: a) On or about June 27, 2023, employees were exposed to burn hazards while entering an unoccupied structure that was on fire without radio communication to transmit vital information between the Dispatch Center, Incident Commander and responding Units. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1960.29 (d): The Agency did not make the investigative report available to the Secretary or his authorized representative on request: a) On or about October 31, 2023, an initial request for a copy of the investigative report into the death of the employee was requested of the Health and Safety Officer. Additionally several requests were made throughout the inspection for a copy of the report and the agency representative failed to provide a copy of the report. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).
