29 CFR 1910.147(d):Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence: On or about June 22, 2023, the employer did not ensure employees performing service and maintenance activities on tank #7 of the silo applied energy controls by; turning off or shutting down the machine[per 1910.147(d)(2)], isolating the electrical energy sources [(d)(3)], affixing lockout device(s) to the energy isolation devices [(d)(4)(i)], and verifying de-energization and isolation had been accomplished [(d)(6)], prior to making adjustments on the machine.

29 CFR 1910.25(c)(2): The employer did not ensure that standard stairs have a maximum riser height of 9.5 inches (24 cm). On or about June 28, 2023, The employer did not ensure the stairs to the silo had a maximum riser height of 9.5 inches. The last two stairs leading to the first platform level had a riser height of approximately 12 1/2 inches each.
