Located at 2564 Sycamore Trace Hilliard, Ohio: On or about June 29, 2023, the employer failed to ensure the employees  were wearing appropriate eye protection while operating  pneumatic nail guns to install roof sheathing on the second story of a new build home.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a.	Located at 2564 Sycamore Trace Hilliard, Ohio: On or about June 29, 2023, the employer failed to ensure that two employee were protected from falling when installing roofing sheathing on a two-story single family new build residential home. Two employees were exposed to a fall of approximately 19 feet from the roofs edge to the ground below.

29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a.	Located at 2564 Sycamore Trace Hilliard, Ohio: On or about June 29, 2023, the employer did not initiate and maintain a safety and health program to ensure the employees were aware of hazards and how to correct those hazards. The two employees were installed OSB sheathing  on a 5 pitch roof of the two story single family new build residential home. The employees were exposed to a fall hazard of approximately 19 feet from the roof edge to the ground below.    Bautista Framing LLC was previously cited for a repeat serious violation of this Occupational Safety and Health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1572663, citation number 1, item number 1a and was affirmed as a final order on May 10, 2022, with respect to a workplace located at Lot 408, 6958 Scarlet Oak Drive Hilliard, Ohio 43026.  Bautista Framing LLC doing business as Miguel Bautista was previously cited for a serious violation of this Occupational Safety and Health standard 29 CFR 1926.20(b)(1),  which was contained in OSHA inspection number 1423728, citation number 1, item number 1 and was affirmed as a final order on January 15, 2020, with respect to a workplace located at Lot 48 6958 Scarlet Oak Drive, Hilliard Ohio, 43026.

29 CFR  1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a.	Located at 2564 Sycamore Trace Hilliard, Ohio: On or about June 29, 2023, the employer failed to instruct the two employees working on the roof installing the roof sheathing on the avoidance of the unsafe conditions when the employees were performing the work on a 5/12 pitch roof. Thereby exposing those employees to falls of approximately 19 feet to the ground below.   Bautista Framing LLC was previously cited for a repeat serious violation of this Occupational Safety and Health standard 29 CFR  1926.21(b)(2), which was contained in OSHA inspection number 1572663, citation number 1, item number 1b  and was affirmed as a final order on May 10, 2022, with respect to a workplace located at Lot 408, 6958 Scarlet Oak Drive Hilliard, Ohio 43026.
