OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:   On or about July 6, 2023, the employer failed to ensure that an employee, who was operating a Brush Bandit Stump Grinder (Model #2550/2550T) was protected from struck by and/or caught in between hazards when operating the machine. An employee was in the process of moving the stump grinder across uneven terrain with slight downward slope and the employee was struck by the stump grinder cutting wheel which was fully activated. The employee sustained fatal injuries.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):   On or about July 6, 2023, the employer failed to conduct, certify, and implement a Hazard Assessment to determine what personal protective equipment was necessary to protect employees from hazards encountered in the workplace. Employees were working in a variety of conditions at different outside job sites and were exposed to hazards that may necessitate the use of personal protective equipment including, but not limited to safety glasses, gloves, and cut resistant clothing during work tasks.
