OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm  in that employees were exposed to struck-by or crushing hazards due to the ejection of an overloaded rear load refuse container.  a) Tomblin Hardware, Oceana, WV: On or about July 12, 2023, and times prior, employees used a 25 cubic yard Pak-Mor Rear Loader refuse collection vehicle to collect waste from a 12-foot-long rear load refuse container. Employees were exposed to ejection/struck-by hazards from the refuse container due to modifications completed on the vehicle that did not adequately secure the load in place and operating the packing mechanism with the refuse container off the ground.
