OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and crushed by hazards.  Address: 250 North Boundary Road, Queens, NY, 11430.  (A) On or about July  17th, 2023. The employer failed to ensure employees operating powered industrial trucks utilized restraint devices when operating the equipment.  An employee operated a Toyota Forklift Model 8FBE18U to move Tri-wall of priority mailboxes without using the seatbelt.  Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19

29 CFR  1910.178(n)(4): Industrial truck driver(s) did not slow down and sound the horn at cross aisles and other locations where vision was obstructed. Where the load being carried obstructed forward view, the driver was not required to travel with the load trailing.  Worksite: 250 North Boundary Road, Jamaica, NY 11430  (A) On or about July  17th, 2023; an operator of a Toyota T43160669 Forklift was driving through the intersection, where there was a pedestrian walking,  and did not sound the horn or slow down to come to a complete stop. And the driver drove with a load in front in the raised position obstructing his clear line of vision as he approached the intersection.   Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19
