29 CFR  1926.651(c)(2):A means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress was not located in trench excavations more than 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.  On or about July 27, 2023, the employer did not provide a safe means of egress in an excavation at least 4 feet deep that did not require employees to travel more than 25 feet laterally. This condition exposed employees to a cave-in hazard.

Protection by placing and keeping such materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary was not provided.  On or about July 27, 2023, the employer did not place or keep materials or equipment at least 2 feet from the edge of excavations, or use retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations. This exposed employees to cave-in hazards.

29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:  On or about July 27, 2023, the employer did not protect each employee from cave-ins by an adequate protective system. This condition exposed employees to a cave-in hazard.  CMD Endeavors Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1328200, citation number 1, item number 1 and was affirmed as a final order on 08-23-2018, with respect to a workplace located at7/8 mile NE of Mesquite and HWY 54, El Paso, TX 79917.
