OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by and crushed by hazards during tree trimming operations.:   Jobsite: On August 02, 2023, employees were exposed to struck by and crushed by hazards while performing tree trimming operations due to a structurally unsound and defective lower boom section on a bucket truck which failed while elevated.

29 CFR  1910.67(c)(2)(v):(v) A personal fall arrest or travel restraint system that meets the requirements in 29 CFR part 1910, subpart I, shall be worn and attached to the boom or basket when working from an aerial lift.  Jobsite: On August 2, 2023, the aerial lift operator was wearing a 3-foot lanyard as part of a personal fall protection system that did not meet 1910.140(d)(2)(ii), when working from a height which would not prevent the employee from contacting the lower level (ground).
