OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck-by equipment or vehicles: On or about August 5, 2023, and at times prior thereto, employees traversing the work yard were exposed to struck-by hazards including, but not limited to, a Mack Dump Truck operating without an audible warning signal for backing (back-up alarm).
