OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to crush-by hazards.  On or about August 7, 2023, employees were exposed to being crushed by the equipment while operating AUSA D601 APG site dumpers near embankments and other unlevel terrain without wearing seatbelts and without securing both bolts and split pins for the Roll Over Protective Structure (ROPS).

29 CFR 1926.50(c): At this job site, the employer did not have a person who was certified in first aid training (which includes Basic First Aid and CPR) available to render first aid.  On or about August 7, 2023, employees were performing excavation work for a golf construction project without the employer providing a person certified to render first aid, exposing employees to the hazards associated with a delay in medical treatment.
