29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:  a) ChemStation International Inc., located at 415 Boot Road, Suite B, Downingtown, Pennsylvania- On or about August 9, 2023, the employer did not conduct an evaluation of each powered industrial truck operator's performance at least once every three years.  An employee who operated a forklift in the production area did not receive refresher training, thereby exposing employees to struck-by hazards.  Training shall consist of a combination of formal instruction, practical training, and evaluation of the operator's performance in the workplace.

29 CFR 1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l):  a) ChemStation International Inc., located at 415 Boot Road, Suite B in Downingtown, Pennsylvania- On or about August 9, 2023, the employer did not certify that each operator has been trained.  An employee who operated a forklift was not trained in the safe operation of powered industrial trucks, exposing employees to struck-by hazards.  Training shall consist of a combination of formal instruction, practical training, and evaluation of the operator's performance in the workplace.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a) ChemStation International Inc., located at 415 Boot Road, Suite B in Downingtown, Pennsylvania- On or about August 9, 2023, the employer did not provide effective training to employees for employees engaged in blending chemical operations.  Employees are exposed to chemicals including but not limited to the following:  - Nitric acid -Phosphoric Acid -Citric Acid found in Liquinat L50 -Sodium Hypochlorite found in ChlorSan 0115 -etc.
