29 CFR  1910.28(b)(3)(i): The employer did not ensure each employee was protected from falling through any hole that was 4 feet or more above a lower level by one or more of the following: covers, guardrail systems, travel restraint systems, or personal fall arrest systems:   a) Aggregate Filling Hopper - Rear of Plant - Employees are exposed to fall hazards, approximately 10 feet, in that the employer does not have a fall protection system in place for employees who are required to conduct housekeeping operations on the walking working surface next to the aggregate filling hopper where there is an opening in the grate big enough for the employee to fall through. This condition was observed on or about October 26, 2023.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  a) Plant Floor - Mechanics Bench - One or more methods of machine guarding from the rotating chuck (350 RPM) was not provided for workers who operate the Milwaukee Drill Press (Serial #502A3204300039), thus exposing employees to ingoing nip points, rotating parts and flying chips. This condition was observed on or about October 26, 2023.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1910.253(a)(3): Apparatus such as torches, regulators or pressure reducing valves, acetylene generators and manifolds used in an oxygen fuel gas system had not been approved:   a) Plant Floor - Mechanics Bench -Oxygen/acetylene torch set up gauge guard for regulator assembly on oxygen cylinder was damaged, in that the protective lens assemblies were missing, thus exposing employees to fire/explosion hazards. This condition was observed on or about August 30, 2023.

29 CFR  1910.253(b)(4)(iii): Oxygen cylinders in storage were not separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet or by a noncombustible barrier at least 5 feet high having a fire-resistance rating of at least one-half hour:  a) Plant Floor - Oxygen compressed gas cylinders were not stored at least 20 feet from acetylene (fuel gas) cylinders. The employer stored four 100 pound oxygen cylinder and three 50 pound acetylene cylinders approximately 10.5 feet from each other, thus exposing employees to fire/explosion hazards. This condition was observed on or about August 31, 2023.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1910.303(b)(2):Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling:  a) Plant Floor Wet Side - Quality Control - The employer allowed employees to use a relocatable power tap (RPT) connected in series with an extension cord and not to a permanently installed branch circuit to energize a fan thereby not using the relocatable power tap in accordance with its listing and labeling, thus exposing employees to electrical and fire hazards. This condition was observed on or about October 26, 2023.
