OSH ACT of 1970 Section (5)(a)(1)  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  a) 241 N Washington Street, Boyertown PA 19512 - On or about September 8, 2023, employees were performing operations utilizing equipment that did not have all of their related hazards effectively addressed.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  a) 241 N Washington Street, Boyertown PA 19512 - On or about September 8, 2023, an employee entered a pinch point area between a stationary vertical support bar and moving horizontal support bar for the bucket to free castings that had become stuck in the bucket of Wheelabrator #7 so that the castings could be deposited into the drum of the wheelabrator.  The employer did not equip Wheelabrator #7 with machine guarding to prevent employees from entering the pinch point area, exposing the employee to caught-in hazards from unguarded moving parts.   Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
