1910.269(a)(3)(iii) The contract employer and the host employer shall coordinate their work rules and procedures so that each employee of the contract employer and the host employer is protected as required by this section. 29 CFR  1910.269(d)(6)(vii): Before starting work on machines or equipment that had been locked out or tagged out, the authorized employee did not verify that isolation and deenergizing of the machine or equipment had been accomplished.  RMS Energy Co., LLC on or about October 10, 2023, at the worksite located at 801 Carpenter Rd. in Defiance, Ohio:  Employees who performed timing testing of the Unit 5 Generator Circuit Breakers and who applied weatherproofing material to the Unit 5 enclosures, were exposed to 13.8kv energized components. The host employer and contract employer had not effectively communicated changes to the planned outage at the facility.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
