29 CFR  1926.451(c)(2)(v): The employer used forklifts  to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied:    a. 103-143 E 22nd St., Bayonne, NJ  The employer did not ensure that a working platform attached to a JCB, Model 508-66TC, Telescopic Handler was secured to the forks.   Employees engaged in the delivery of materials, that included,  but was not limited to counter tops, kitchen sinks, and bathroom sinks,  to the fifth level of a multi-unit residential building entered the work platform to unload sinks where the platform was not fully secured to the forks and carriage to prevent tipping or becoming dislodged from the forks.  Violation occurred on or about October 28, 2023

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     a. 103-143 E 22nd St., Bayonne, NJ  The employer did not ensure that an employee was protected from falls.   An employee engaged in the delivery of materials, which included,  but was not limited to counter tops and sinks,  to the fifth level of a multi-unit residential building was not using any means of fall protection while guiding a JCB, Model 508-66TC, Telescopic Handler, up to the building to unload the materials and when unloading the countertops from a rack that was lifted up the opening and placed inside the building.  Violation occurred on or about October 28, 2023

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:  a. 103-143 E 22nd St., Bayonne, NJ  The employer did not ensure that a working platform attached to a JCB, Model 508-66TC, Telescopic Handler, had the manufactures written approval prior to use by employees.   Employees engaged in the delivery and installation of  materials that included, but were not limited to counter tops, bathroom sinks, and kitchen sinks,  to the fifth level of a multi-unit residential building worked from an unauthorized work platform attached to the forks.  Violation occurred on or about October 28, 2023
