29 CFR 1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):   a) 13838 Harllee Rd., Palmetto, FL - on or about 10/30/2023, employees removing scrap metal from the shaft of the SH1 120-104 Industrial Shredder while standing on the ledge of the shredder were exposed to a 13-foot, 3-inch fall hazard, in that fall protection equipment was not installed or utilized.

29 CFR  1910.67(b)(2): A modified aerial lift(s) was not certified by the manufacturer or NRTL as being at least as safe as the equipment was before modification:   a) 13838 Harllee Rd., Palmetto, FL - on or about 10/30/2023, employees were exposed to a fall hazard when a Genie S-60X aerial lift, serial number S60X12-23191 was field modified without the manufacturer's approval. The aerial lift was modified by attaching a synthetic sling to the bottom of the basket to aid in removing scrap metal from the shaft of the SH1 120-104 Industrial Shredder.

29 CFR  1910.67(c)(2)(v): A personal fall arrest or travel restraint system that meets the requirements in subpart I of this part was not worn and attached to the boom or basket when working from an aerial lift:   a) 13838 Harllee Rd., Palmetto, FL - on or about 10/30/2023, employee removing scrap metal from the shaft of the SH1 120-104 Industrial Shredder working from a Genie S-60X aerial lift, serial number S60X12-23191, was exposed to a 34-foot, 6-inch fall hazard, in that a restraint device was not utilized.
