OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Location: 15 Whitehall Road, Andover, New Jersey 07821 a) Employees were exposed to struck-by hazards of collapsing racks of the commercial metal storage racking system and their contents while the employees warehoused merchandise which included, but was not limited to cases, boxes, and other means of packaging for production of weight loss pills, energy drinks, and multivitamins. Commercial steel storage racks had bent or damaged stanchions and damaged anchor points. Violation observed on or around November 11, 2023

29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: Location: Capsule Room, 15 Whitehall Road, Andover, New Jersey 07821 a) The employer did not administer a continuing, effective hearing conservation program for employees in the capsule room. On January 4, 2024 three employees in the capsule room working near and operating the Bosch GKF1500 Capsule Filler Machine were exposed to noise levels that were equivalent to 68.3%, 73.5%, and 69% of the allowable dose of 50%, or 85dBA for an 8 hour Time Weighted Average. Employees were exposed to noise levels of 87.2 dba, 87.7 dba, and 87.3 dba, respectively. Employees were sampled for 362 minutes, 298 minutes, and 291 minutes. Zero exposure is assumed for the unsampled periods of 118 minutes, 182 minutes, and 189 minutes. Violation occurred on or around January 4, 2024
