29 CFR 1910.146(c)(2): The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of, and the danger posed by the permit spaces:  a) On the Kiln, Hoosier Magnetics, Inc., 110 Denny Street, Ogdensburg, NY, 13699, on or about 11/9/2023: A confined space danger sign was not posted on the Kiln and employees were not informed by other means that the kiln was a permit-required confined space.  b) On the Ball Mill, Hoosier Magnetics, Inc. 110 Denny Street, Ogdensburg, NY, 13699, on or about 11/9/2023: A confined space danger sign was not posted on the Ball Mill and employees were not informed by other means that the Ball Mill was a permit-required confined space.  c) On the Process Tank, Hoosier Magnetics, Inc. 110 Denny Street, Ogdensburg, NY, 13699, on or about 11/9/2023: A confined space danger sign was not posted on the Process Tank and employees were not informed by other means that the Process Tank was a permit-required confined space.  NOTE: A sign reading DANGER-PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER or using other similar language would satisfy the requirement for a sign.

29 CFR  1910.146(c)(7)(iii): The employer did not document the basis for determining that all hazards in a permit space had been eliminated, through a written certification that contained the date, the location of the space, and the signature of the person making the determination:   a) The Ball Mill, Hoosier Magnetics, Inc., 110 Denny Street, Ogdensburg, NY, 13699, on or about 11/2/2023: Employees entered into the Ball Mill to remove, repair, and replace "wear plates". Procedures for entry into the space were not documented prior to entry into the Ball Mill, which was a permit-required confined space.   b)The Kiln, Hoosier Magnetics, Inc., 110 Denny Street, Ogdensburg, NY, 13699, on or about 11/3/2023: Employees entered into the Kiln to remove refractory material, and procedures for entry into the space were not documented prior to entry into the Kiln, which was a permit-required confined space.    Abatement certification is required.

Employees were not trained in the health hazards associated with exposure to respirable crystalline silica, the specific tasks in the workplace that could result in exposure to respirable crystalline silica, or what measures the employer has implemented to protect employees from exposure to respirable crystalline silica.
