Safety-related work practices shall be employed to prevent electric shock or other injuries resulting from either direct or indirect electrical contacts, when work is performed near or on equipment or circuits which are or may be energized. The specific safety-related work practices shall be consistent with the nature and extent of the associated electrical hazards.  On or about November 7, 2023, at a worksite located at 4721 Barnsleigh Drive, Akron, Ohio, the employer failed to ensure safety-related work practices were employed to prevent the electrocution of an employee from either direct or indirect contact with energized powerlines, when the installation of Christmas lights was performed near energized 69kV overhead powerlines.

29 CFR  1904.39(a)(1):Basic Requirement.  Within eight (8) hours after the death of any employee as a result of a work-related incident, you must report the fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor.  On or about November 8, 2023, the employer failed report the work-related death of an employee within 8 hours to the Occupational and Health Administration (OSHA).  The work-related incident occurred on November 7, 2023, and the employee was pronounced dead at approximately 0335hrs on November 8, 2023. OSHA was not notified of the work-related employee death on November 13, 2023, at approximately 1330hrs.
