29 CFR 1910.67(c)(2)(v): A personal fall arrest or travel restraint system that meets the requirements in subpart I of this part was not worn and attached to the boom or basket when working from an aerial lift: a) On November 14, 2023, at the above addressed jobsite, the employer did not ensure that all persons who operated vehicle-mounted elevating and rotating work platforms, such as the 2005 Freightliner Truck with an Altec LRV55 Aerial Bucket, donned a harness and lanyard attached to the boom or basket. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.135(a)(1):The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects: a) On November 14, 2023, at the above addressed jobsite, the employer failed to ensure the use of head protection, such as hard hats, for employees that were exposed to falling objects and debris during tree trimming. The employee was observed working below a bucket operator that was above cutting branches that fell near the employee's location. No abatement certification or documentation is required for this item.
