OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and struck-by hazards:  On or about November 2, 2023, employees performed work activities including, but not limited to loading and unloading service trash containers from a flatbed utility trailer while the equipment was under tow.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye:    On or about November 2, 2023, an employee suffered an injury that resulted in an in-patient hospitalization that was not reported within 24-hours to the local Area Office of the Occupational Safety and Health Administration.
