OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to an employee in that employee was exposed to struck by and crushing hazards while working under or near a load suspended by a tow truck.  a) Salvage yard at 259 Garland Napier Salvage Dr; On or about November 27, 2023 and times prior, the employer used a tow truck equipped with a winch and two cables to wrap around a vehicle's axles to lift the vehicle.  An employee performed work next to and under vehicles without the vehicles being supported, cribbed, or braced exposing the employee to struck by and crushing injuries.

29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident.  a) Yellow house at the entrance of 259 Garland Napier Salvage Drive; On or about November 27, 2023, an employee received fatal injuries while attempting to remove a tire from a suspended vehicle. The fatality was not reported to OSHA until November 28, 2023.
