OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to shear points:  On December 8, 2023, and times prior the employees were exposed to a shear point hazard created by rotating parts while performing activities such as, warming up the hydraulics on the rod tongs while servicing Precision Energy; Model M50.   Among other methods, feasible and acceptable means to abate this hazard include but are not limited to:  1.	Implementing and following procedures established in ANSI Z 244.1 "Control of Hazardous Energy Lockout/Tagout and Alternative Methods. 2.	Implement and follow the American Petroleum Institute (API) RP 54 section 6.9 "Lockout/Tagout".  3.	Install an effective guarding mechanism that would protect employees engaged in operations exposing them to rotating parts and shear points.

29 CFR 1910.132(d)(1)(iii): The employer did not select PPE that properly fit each affected employee:  On December 8, 2023, and times prior the employer did not ensure the PPE, such as gloves that they provided were the proper size and fit for each employee who performs activities such as, warming up the hydraulics on the Precision Energy; Model M50 rod tongs.
