29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a. A worker in the pallet dismantling area was exposed to a noise dose of 275.8%, or an equivalent dBA of 96.2 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 412 minutes during one shift on March 5, 2024. The employer did not have a continuing, effective hearing conservation program.  b. A worker in the pallet assembly area was exposed to a noise dose of 235.9%, or an equivalent dBA of 98.3 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 417 minutes during one shift on March 5, 2024. The employer did not have a continuing, effective hearing conservation program.

29 CFR  1904.41(a)(2): The establishment had 20 or more employees but fewer than 250 employees at any time during the previous calendar year, and the establishment was classified in an industry listed in appendix A to subpart E of this part, and the employer did not electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee by the specified date:   a. Chico Pallets Corp DBA, Cobra Pallets. located at 6629 Muriel St., Jacksonville Florida:  On or about March 2,  2024 and times prior thereto, the employer failed for calendar year 2023, to electronically submit information from the OSHA Form 300A or equivalent by 03/02/2024. The establishment employed approximately 21 employees and was classified in the North American Industrial Classification System as  321920 during calendar year 2023.
