OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck-by equipment:         (a) On or about January 9, 2024, at 420 South Coit Road, Prosper, Texas employees were exposed to a struck-by hazard while working around an operating Komatsu Excavator.

Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations or using retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  (a)	On or about January 10, 2024, and at times prior thereto, employees working at the St. Paul Episcopal Church in an excavation were exposed to the hazard of excavated materials falling into the excavation.
