29 CFR  1926.451(f)(3):Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:  On or about January 18th, 2024, employees engaged in residential construction activities, located at 75663 HWY 47, Gothenburg, NE 69138, were exposed to fall hazards in that employees were using fabricated scaffolding as means of performing work over 10 feet and the employer failed to ensure the scaffolding had  been inspected prior to use.  Examples of this failure include but are not limited to the failure to recognize the lack of adequate fall protection/guard railing when working on a scaffold over 10 feet.

29 CFR  1926.451(f)(7):Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person.  On or about January 18th, 2024, employees engaged in residential construction activities, located at 75663 HWY 47, Gothenburg, NE 69138, were exposed to fall hazards in that employees were using fabricated scaffolding that had not been erected under the supervision of a competent person.

29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level.  On or about January 18th, 2024, employees engaged in residential construction activities, located at 75663 HWY 47, Gothenburg, NE 69138, were exposed to fall hazards in that employees were using the fabricated scaffolding on sight to access work  over ten feet from the ground below and the employer has failed to ensure the scaffolding was  outfitted with adequate guard railing or other means of conventional fall protection.
