29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:   On or about January 22, 2024, the employer failed to ensure an employee who was operating a remote-controlled Hurricane RS Stump Grinder (vin 1J9HH3132J1167428) was protected from struck by or caught in hazards. The employee had finished grinding a stump and was in the process of moving the stump grinder on uneven terrain while standing within 10 feet of cutter wheel that was fully engaged when they were struck by the cutter wheel sustaining fatal injuries.
