29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  a.	Building Maintenance - On or about January 25, 2024, employees voluntarily used a 3M 6500 series Half Facepiece Respirator and an MSA Advantage 200 LS Half Mask Respirator, when conducting building maintenance activities. The employer failed to implement those elements of a written program including medical evaluation and training, thereby exposing employees to respiratory hazards.

Facility - On or about January 25, 2024, the employer did not ensure that each employee voluntarily wear a tight fitting half-facepiece respirator was provided with a medical evaluation to determine their ability to use a respirator.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  a.   On or about January 25, 2024, employees performing welding in the shop were provided half face tight-fitting 3M 6500 series Half Facepiece Respirator and an MSA Advantage 200 LS Half Mask respirators for voluntary use. The employer did not provide the information contained in 29 CFR 1910.134, Appendix D ("Information for Employees Using Respirators When Not Required Under the Standard").
