29 CFR 1910.22(a)(1): 29 CFR 1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition. On or about January 31, 2024, and times prior thereto at this workplace employees conducted grain handling operations, an employee entered grain bin #2 and the walking working surfaces were not clear of knee-deep grain, the employee lost balance and stepped into a rotating floor auger in operation.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about January 31, 2024, and times prior thereto at this workplace employees conducted grain handling operations entered grain bin (silo) #2 via the entrance ladder and stepped on the unguarded motor and pulley assembly to gain access inside the grain bin.

29 CFR 1910.272(e)(1): The employer did not provide training to employees at least annually and when changes in job assignments would expose them to new hazards in the grain handling facilities. On or about January 31, 2024, and times prior thereto at this workplace employees conducted grain handling operations, the employer did not provide adequate training to newly hired employees that all electrical equipment which presents a danger to the employees inside grain bin #2 shall be disconnected, lockout tagged out prior to entry.

On or about January 31, 2024, and times prior thereto at this workplace employees conducted, grain handling operations, in grain bin (silo) #2 while the floor auger was energized and was not disconnected / locked out and tagged out. Employees were exposed to caught-in hazards resulting in amputations or death.
