29 CFR 1926.51(c)(2): Under temporary field conditions, provisions were not made to assure that not less than one toilet facility was available: a) Field Worksite - On or about February 7, 2024, employees were not provided rest room breaks in a timely manner. Employees on a two (2) flagger team must wait extended periods for someone to relieve them of their flagging duties before they are able to take restroom breaks. IN THE ALTERNATIVE 29 CFR 1910.141(c)(1)(ii): Employees performing activities such as traffic control in work zones in remote areas are not provided with timely rest room breaks: a) Field Worksite - On or about February 7, 2024, employees were not provided rest room breaks in a timely manner. Employees on a two (2) flagger team must wait extended periods for someone to relieve them of their flagging duties before they are able to take restroom breaks.
