29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles: (a)Cleary Building Corp. at 13012 Bethlehem Road, Summerset, SD 57718: On or about and at times prior to February 12, 2024, the exposing employer did not ensure that each employee that was installing steel trim material on a commercial property with the use of a battery powered narrow crown stapler was protected from flying particles by the use of appropriate eye protection. This condition exposed employees to struck-by hazards.

29 CFR 1926.760(a)(1): Each employee engaged in steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems: (a)Cleary Building Corp. at 13012 Bethlehem Road, Summerset, SD 57718: On or about and at times prior to February 9, 2024, the employer did not ensure employees were protected from fall hazards while installing corrugated steel roof decking material on the roof of a wooden pole-to-truss pole barn. This condition exposed employees to fall hazards greater than 15 feet.
