29 CFR 1915.87(c)(1): The employer did not ensure that a first aid provider was able to reach an injured/ill employee within five (5) minutes of a report of a serious injury, illness, or accident such as one involving cardiac arrest, acute breathing problems, uncontrolled bleeding, suffocation, electrocution, or amputation:  a)	Chesapeake Marina LLC, dba Top Rack Marina: On or about 2/15/2024, the employer failed to ensure that a first aid and CPR provider was available to respond within 5 minutes in that the nearest first aid provider was 8-11 minutes away from their location.   No abatement certification or documentation required.

29 CFR  1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a)	Chesapeake Marina LLC, dba Top Rack Marina: On or about February 15, 2024, the employer failed to develop, implement, and maintain a written hazard communication program regarding the flammable, combustible, and other chemicals used by employees.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
